An experienced insurance defense attorney, Josh has more than 19 years of experience successfully representing corporations, businesses, individuals, and insurance providers in defense claims, particularly in eastern Kentucky. His primary practice area involves insurance defense as both counsel and a litigation defense attorney. Other areas of specialty for Josh include premises liability litigation, civil defense litigation, personal injury defense litigation, personal workers’ compensation defense, real estate law, probate, corporate law, and medical negligence claims.

Over the years Josh has been retained by over a dozen insurance providers in a wide variety of matters, including auto negligence, slip and falls, trip and falls and medical negligence. He has been successful obtaining resolution in multiple courts throughout eastern Kentucky. Josh’s philosophy is to achieve the best results for his clients through diligent hard work and maintaining a collaborative approach by empowering carriers and their insured with information needed to make good, strategic decisions throughout the litigation process.

Areas of Practice

  • Successfully briefed arguments in breach of contract and defamation case before the Kentucky Court of Appeals.

    Successfully overturned on appeal a denial of automobile dealer’s motion to compel arbitration of a negligent maintenance claim based on purchasing contract requiring arbitration of any dispute.

    Compelled a negligent lemon law case to arbitration.

    Successfully obtained partial summary judgment on the question of agency in a property damage case.

    Successfully obtained a dismissal in a breach of warranty case.

    Successfully obtained a dismissal in a premise liability case after plaintiff’s counsel was forced to withdraw after Plaintiff’s deposition testimony.

    Successfully briefed multiple arguments in favor of Motions for Protective Order.

    Successfully briefed arguments defeating Motions for Partial Summary Judgment on liability.

    Successfully briefed arguments in favor of declaratory judgment limiting liability insurance coverage.

  • Josh has been actively involved in The Rotary Club of Pikeville, Ky., for more than fifteen years. Josh believes in Rotary’s Motto of Service of Above Self and tries to model his life after Rotary’s Four-Way Test. He received the Club’s International Service Award in 2007-08, and was honored with the 2015-2016 Distinguished Service Citation. Josh also serves as Chair of the Board of the Appalachian Center for the Arts in Pikeville, Ky.
