  • Defense of shareholder actions and class actions against companies.
  • Represented creditors in a number of major Chapter 11 bankruptcies in Kentucky, New Jersey, New York and Virginia, and obtained critical vendor settlements or allowances of claims, and successfully defended or negotiated settlements of avoidance actions for clients.
  • Won summary judgment in litigation over a $1.5 million build-to-suit lease dispute, and were granted costs and attorneys’ fees in the full amount expended by the client in the case to date.
  • Litigated non-competition covenants in several state and federal courts in Kentucky.
  • Defended several accounting firms in professional liability actions concerning audits, tax preparation and other accounting services.
  • Represented employers in fidelity bond claims and claims against banks or auditors arising from employee embezzlement.
  • Represented victims of Ponzi schemes in state court civil actions and in bankruptcy court preference litigation.
  • Defended companies in and successfully defeated efforts to certify class actions.
  • Phil Moloney holds the record punitive damage verdict in a home builder defects case in Kentucky.
  • Kevin Henry was named Lexington “Lawyer of the Year” in 2013 in banking & finance litigation and has consistently been a Kentucky Super Lawyer in business litigation.
