Kevin is Sturgill Turner’s most experienced business litigator, with a diverse trial and appellate practice hallmarked by several high profile successes. He has been lead counsel in more than 20 jury trials and 40 plus appeals in both federal and state courts, in all manner of financial and fiduciary litigation involving banking, will contests, trust mismanagement, contracts, Director and Officer liability, equine disputes, antitrust, representation of Ponzi scheme and embezzlement victims, and lawyer and accountant malpractice. Kevin also has represented creditors and debtors in several prominent bankruptcy cases in Kentucky, Tennessee and New Jersey. He has been a volunteer coach for the University of Kentucky College of Law’s Bankruptcy Moot Court Team for seven years.
Most notable among Kevin’s recent cases was his successful defense of the Lexington-Fayette Urban County Airport Board and the Lexington-Fayette Airport Corporation against Comair in its attack on sovereign immunity, in which the Kentucky Supreme Court adopted his suggestion that the Berns test for sovereign immunity should be refined when dealing with county boards and affiliated corporations. Comair, Inc. v. LFUCG Airport Board, et al., 295 S.W.3d 91 (Ky. 2009).
